Terms of Service

These Terms of Service (“Terms”) govern your use of the ControlsDeck Robot Backup Tool (“Software”). By installing or using the Software, you agree to these Terms.

1. Provider

The Software is provided by Joseph Bunch, operating under the brand ControlsDeck (“we,” “us,” or “our”).

2. License Grant

We grant you a limited, non-exclusive, non-transferable license to install and use the Software according to your purchased plan. Licenses are seat-based and may be limited to specific devices or users. We reserve the right to revoke or suspend licenses in cases of misuse or violation of these Terms.

3. Restrictions

• You may not reverse-engineer, decompile, or attempt to derive source code from the Software.
• You may not resell, sublicense, or distribute the Software without written permission.
• You may not use the Software for unlawful purposes.

4. Payments and Refunds

Payments are processed through our payment provider. Except as required by applicable law, all purchases are final. Refunds are only offered within 7 days of purchase. After 7 days, no refunds will be provided unless your jurisdiction legally requires it, in which case refunds may be prorated.

5. Termination

We may suspend or terminate your license if you violate these Terms. Upon termination, you must stop using the Software and uninstall it from all devices.

6. Disclaimers

The Software is provided “as is” without warranties of any kind, whether express or implied. We do not guarantee that the Software will be error-free, uninterrupted, or fit for a particular purpose.

7. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the amount you paid for the Software. We are not responsible for indirect, incidental, or consequential damages, including but not limited to lost profits or production downtime.

8. Governing Law

These Terms are governed by and construed under the laws of the State of South Carolina and applicable U.S. federal law. Any disputes shall be resolved in the courts located in South Carolina.

9. Updates to Terms

We may update these Terms from time to time. Continued use of the Software after changes are posted constitutes your acceptance of the revised Terms.
